Revised Daly City Housing Ordinance
As reported earlier in Daly City to Consider Home Resale Inspection Ordinance , Daly City’s Department of Economic and Community Development is proposing a Residential Resale Inspection Program for Daly City that targets the construction of illegal rooms and additions in residential structures. The proposal is contained in the city’s Draft Housing Element.
Among other things, the program would require property owners to obtain a resale permit from the city prior to the close of escrow for any property sale. The abatement of specified illegal conditions would have to be required before a permit could be issued.
On August 20, the city issued a revised Draft Housing Element. The most meaningful differences between the original and the revised draft element are the following:
The Residential Resale Inspection Program now targets “the abatement of habitable rooms and additions that have been constructed illegally in residential structures containing one and two dwelling units,” instead of “the abatement of dangerous living conditions caused by the construction of illegal rooms and additions in residential structures containing one to four dwelling units.”
The Residential Resale Inspection Program now mandates “energy efficient upgrades in ALL existing residential structures, including apartment buildings, instead of residential structures containing just one to four dwelling units.”
The revised Draft Housing Element is expected to be considered by Daly City’s City Council this month in September.
